Description: The Criminal Law Advisory Committee proposes adding standard 4.15 to the California Standards of Judicial Administration to provide guidance to judges and court administrators on procedures to implement vacatur relief under Penal Code section 236.14. Section 236.14 provides, in relevant part, for a petition process to vacate an arrest or conviction for a nonviolent offense while the petitioner was a victim of human trafficking, and for the sealing and destruction of the petitioner’s arrest records.
